1. Who we are and what this policy covers

EverlySong is a custom song service. You answer a short quiz about someone you love, and we write, record and deliver a song made from your answers. The song is delivered as a digital file — an MP3, plus a lyric sheet PDF where that is part of your order. Nothing is shipped.

The business responsible for your information (the “controller”, if you are used to that term) is Arcadia Labs, LLC, a company organized in Wyoming, doing business as EverlySong. In this policy “we”, “us” and “EverlySong” mean that company.

This policy covers everlysong.com, our quiz, our checkout and order pages, the emails and texts we send, and our creator (UGC) program. It does not cover websites we do not operate, even if we link to them.

You do not need an account to buy from us, and we do not sell subscriptions. There is nothing recurring to cancel.

2. The information we collect

Contact detailsWhat it is: email address (required), phone number (optional), first name if you give one.
Why we need it: to deliver your song, send order and revision updates, and answer support.
Where it comes from: you, in the quiz or at checkout.
Quiz content — including details about someone elseWhat it is: who the song is for and their name; the music genre; the voice; three free-text answers (a quality of the person, memories, your message); the language of the song.
Why we need it: these answers are the song. Without them there is nothing to write.
Where it comes from: you. See the note directly under this table.
Payment informationWhat it is: order total, items bought, the last four digits and brand of your card, billing name and ZIP, approval or decline result. Not your full card number, and not your CVV — we never receive them.
Why we need it: to charge you, to run one-click upsells you accept after checkout, and to handle refunds and chargebacks.
Where it comes from: our checkout platform and payment gateway, which take the card data directly from you.
Technical and browsing dataWhat it is: IP address, approximate location from that IP, device and browser type, referring page, pages viewed, quiz steps completed, timestamps.
Why we need it: to keep the site working, prevent fraud and abuse, and see which pages are broken or confusing.
Where it comes from: collected automatically by your browser and by our hosting, analytics and checkout tools.
Cookies, pixels and ad identifiersWhat it is: cookie and session IDs, Meta pixel events (page view, quiz start, purchase), click IDs from the ad you arrived on.
Why we need it: to remember your quiz progress, measure which ads work, and show ads to relevant audiences.
Where it comes from: your browser, our analytics tools, and Meta.
Creator (UGC) contentWhat it is: reaction videos you send us, the name you want shown, your signed release, and the details needed to send your gift card.
Why we need it: to review your video, pay the gift card, and — if you signed the release — use the video in marketing.
Where it comes from: you, when you choose to join the program.
Support communicationsWhat it is: your emails to us, the order they concern, what you asked for, what we did.
Why we need it: to resolve your issue, honor revisions and refunds, and keep a record of what was agreed.
Where it comes from: you, and our support tooling.

About the person the song is for

This part matters, so we are stating it plainly. The free-text answers in our quiz are information about a third party — the person receiving the gift. Their name, a quality you admire in them, shared memories, sometimes a health event, a loss, a relationship or a family detail. We treat that content as personal information belonging to them, not only to you.

By submitting the quiz you confirm that:

If you are the person a song was written about and you want it deleted, email support@everlysong.com. We will act on that request, and we may need enough detail to find the order.

Please do not send us Social Security numbers, financial account numbers, government ID numbers, medical records or login credentials. We do not need them, and the quiz has no reason to ask.

3. How we use your information

We use what we collect for these purposes, and no others without telling you first.

To perform our contract with youWriting, recording and delivering your song; delivering the lyric sheet where included; handling revisions; processing your payment and any upsell you accept; issuing refunds under our Return Policy.
With your consentSending marketing emails or texts; setting non-essential cookies and advertising pixels where consent is required; using your reaction video in our marketing under a signed release.
For our legitimate business interestsKeeping the site up and secure; detecting fraud and card testing; measuring ad performance; improving the quiz and our production process; enforcing our Terms of Service.

We do not use your quiz answers to train our own general-purpose models, and we do not publish your song or your answers publicly. If we ever want to show a song as an example, we ask first.

We do not make automated decisions about you that have legal or similarly significant effects. Fraud screening at checkout is run by our payment vendors and may decline a card; if that happens you can contact us and a human will look at it.

How your song is actually made

You are entitled to know where your words go. A human songwriter shapes your quiz answers into lyrics. The composition and the vocal are then produced with the help of AI-assisted music generation tools operated by a third-party vendor. In practice this means: the text you write in the quiz is sent to a third-party music generation provider (see section 4), together with the genre, voice and language you selected. We share the creative brief needed to make the track — not your payment details.

4. Who we share it with

We share personal information with service providers who work on our behalf, under contract, and only for the purposes below. Vendor names are being finalized and will be listed here before launch.

We do not sell your personal information for money. We do not share your quiz answers with data brokers, and we do not rent or trade our customer list. The only nuance is the advertising one described in the next section.

5. Cookies, pixels and tracking

We use a small number of cookies and similar technologies. They fall into three groups.

Strictly necessaryKeep your quiz answers as you move between steps, keep your cart and order together, block fraud. These cannot be switched off without breaking the checkout.
AnalyticsCount visits, show us where people abandon the quiz, tell us which pages load badly. Aggregated; we do not use them to build a profile of you.
AdvertisingThe Meta pixel and similar tags. They tell Meta that a visit, quiz start or purchase happened, so we can measure our ads and show ads to relevant audiences.

How to refuse them

California: this may be “sharing”

Using the Meta pixel to show you targeted ads can qualify as “sharing” personal information for cross-context behavioral advertising under the California Consumer Privacy Act as amended by the CPRA — even though no money changes hands. California residents can opt out at any time.

Email support@everlysong.com with the subject line “Do Not Sell or Share”, from the email address you used to order. We action it within 15 business days and confirm by reply.

An opt-out applies to the browser and device you send it from, and to the customer record we can match it to. We do not require an account to opt out, and opting out does not change the price you pay or the song you get.

We do not knowingly sell or share the personal information of anyone under 16.

6. Your privacy rights

If you live in California

Under the CCPA/CPRA you have the right to:

If you live in Virginia, Colorado, Connecticut, Utah, Texas or another US state with a privacy law

You generally have the right to confirm whether we process your data, access it, correct it, delete it, get a portable copy, and opt out of targeted advertising and of the sale of personal data. Where the law provides it, you also have the right to appeal a refusal — reply to our decision email and we will review it and respond, and tell you how to contact your state Attorney General if you are still unhappy. We do not use your data for profiling that produces legal or similarly significant effects.

If you are in the EU, the UK or another GDPR-style jurisdiction

We sell to the United States, but if you reach us from the EU or UK you have the right to access, rectification, erasure, restriction, portability, and objection to processing based on legitimate interests or direct marketing. Where we rely on consent, you can withdraw it at any time — that does not affect processing already carried out. You can lodge a complaint with your local supervisory authority; in the UK that is the Information Commissioner’s Office.

How to exercise any of these rights

Deleting your data may mean we can no longer send you your song again, honor a revision, or process a refund for that order. We will warn you before we act if that is the case.

7. How long we keep things

We keep information only as long as we have a reason to. When a period ends we delete the data or strip it of anything that identifies you.

On quiz text and finished songs specifically: your answers and your song stay in our systems and with our production vendor for the period above, then they are deleted. You can ask us to delete them sooner at any time — email support@everlysong.com — as long as you accept that we can no longer re-send or revise that song afterwards.

8. Security

We take reasonable and appropriate steps to protect your information: encryption in transit (HTTPS), access limited to the people who need it, vendors chosen partly on their security posture, and card data handled by PCI-compliant processors rather than by us.

No website, vendor or company can promise perfect security, and we will not pretend otherwise. If a breach affects your personal information, we will notify you and the relevant authorities as the law requires. If you think your information has been exposed, tell us at support@everlysong.com.

9. Children

EverlySong is for adults. Our service and our site are not directed to children, and we do not knowingly collect personal information from anyone under 18 — or under 16 where a lower age applies. You must be 18 or older to place an order or to join our creator program.

A song can of course be about a child, and a parent or guardian may write about their own child. In that case the adult placing the order is responsible for what they choose to share with us.

If you believe a minor has given us personal information, email support@everlysong.com and we will delete it.

10. International data transfers

We are based in the United States and our data is stored and processed in the United States. Some of our vendors — including our music production provider — may process data in other countries. Privacy laws in those countries may be different from the ones where you live.

Where we transfer personal data out of the EU, the UK or Switzerland, we rely on the European Commission’s Standard Contractual Clauses, the UK Addendum, or another lawful transfer mechanism, together with contractual confidentiality and security terms with each vendor. Details of the mechanism used for a specific vendor are available on request: our vendors are US-based and process the data in the United States.

11. Email and SMS marketing

Email. Everyone who orders gets transactional email — receipt, progress, the delivery link, revision replies. That is part of the service, not marketing, and it cannot be unsubscribed from while an order is open. Promotional email goes only to people who opted in. To stop it, click “unsubscribe” at the bottom of any promotional email, or email support@everlysong.com.

SMS. The phone number in our quiz is optional. Leaving it out does not affect your order or your delivery. Giving it to us does not sign you up for marketing texts: we send marketing SMS only if you separately opt in by checking a clearly labeled box. Without that opt-in we use your number only for something specific about your order.

We do not run an SMS marketing program. The phone number is optional and is used only for delivery updates about an order you placed. If we ever start sending marketing texts, we will ask for separate consent first and publish the program terms here.

Creator program. If you send us a reaction video, we use the contact details you give us to review the video, send your gift card ($25 for a submitted video, $50 if your video is selected for use), and confirm your signed release. Joining is voluntary and does not sign you up for marketing.

12. Changes to this policy

We update this policy when what we do changes — a new vendor, a new tool, a new legal requirement. When we make a material change we update the “Last updated” date at the top and, if the change affects how we use information you already gave us, we tell you by email or with a notice on the site before it takes effect.
