Terms of Service
These terms govern your use of the EverlySong website and anything you buy from it. Please read them before you order. Placing an order means you accept them.
1. Acceptance
By using the EverlySong website (the “Site”) or buying any song or add-on from it (the “Products”), you agree to these terms. If any part of them is unacceptable to you, do not use the Site and do not place an order. These terms form a binding agreement between you and Ancho Solutions LLC. EverlySong is operated by Ancho Solutions LLC.
2. What we sell
EverlySong sells personalized songs and digital add-ons for them. Your song is created from your answers using AI-assisted songwriting and production tools, then reviewed by our team before delivery. Everything is delivered digitally, by email, to the address you give at checkout. Nothing physical is sent, so no postage or delivery charges apply.
3. Ordering and delivery times
After checkout you answer six questions about the person the song is for. The 30-minute song is delivered within 30 minutes and the 48-hour song within 48 hours. The clock starts once your order and your answers are both complete. The Upgrade to 30-Minute Delivery ($40) moves a 48-hour song to 30-minute delivery. If we miss a 30-minute window, we refund the rush fee.
Add-ons attach to a song. The Complete Package, Release on Spotify & Apple Music, Full Rights to the Recording, the Instrumental Version and The Third Verse (with a new song) are added in the same order as a new song. The Upgrade to 30-Minute Delivery (for a 48-hour song), the Printable Lyric Sheet and The Third Verse (for a song you already have) can also be ordered on their own for a song you ordered earlier; use the same email address as that order. Release dates on Spotify and Apple Music are set by the distributor and the stores, not by us, and we do not promise plays, playlist placements or earnings.
4. Prices and payment
Prices are shown in United States dollars (USD) and are one-time payments. Nothing renews and there are no subscriptions. You pay the price displayed when you order; a later price change never affects an order already placed. We accept Visa and Mastercard, processed by encrypted third-party payment providers. We do not keep your full card number on our systems.

5. How charges appear
Payments appear on a card or bank statement as “EVERLYSONG” or a close variant of it. If a charge is unfamiliar, please write to support@everlysong.com before opening a dispute with your bank or card issuer. We can usually resolve it faster than a dispute can.
6. Revisions
One free round of lyric revisions, requested within 14 days of delivery. A revision covers corrections to names or details from your answers and changes to lyrics or phrasing. Write to support@everlysong.com to request it.
7. Refunds
30-day money-back guarantee: if you're not happy with your song, email us within 30 days of delivery for a full refund. Asking for a revision first is optional and never a condition of the refund. If we miss a 30-minute delivery window, we refund the rush fee even if you keep the song. See the Refund Policy for the steps.
8. What you send us
You keep every right you have in the answers, names, stories and other material you give us (“Your Content”). You give us a limited licence to use Your Content only to make, revise and deliver your song and to support your order. We use your song or Your Content in our marketing only if you give us separate permission, and you can withdraw that permission at any time by emailing us. Please only send us details about other people that you are comfortable sharing, and nothing unlawful.
9. Your licence to the song
Every song comes with a personal, non-commercial licence that does not expire: you can keep it, play it and share it with family and friends. Commercial use, distribution and selling the recording need Full Rights to the Recording ($29) or The Complete Package, which give you ownership of the master, commercial use, the right to distribute and sell the recording, exclusivity and the master WAV file.
10. AI-assisted production
Songs are made with AI-assisted songwriting and production tools, and our team reviews each song before delivery. Each song is made for your order from your answers. Because AI-assisted music draws on common musical patterns, short melodic or lyrical phrases may resemble other works.
11. Who may buy
You must be 18 or older to buy from EverlySong. Placing an order confirms that you are, and that you can enter a binding agreement.
12. What you agree not to do
You agree not to: (a) use the Products for anything unlawful; (b) submit content that infringes anyone’s rights or that you have no right to share; (c) resell or redistribute a song commercially without Full Rights to the Recording; (d) supply fraudulent payment details or dispute a charge you know to be legitimate.
13. Limit of our liability
So far as the law allows, Ancho Solutions LLC and its owners, officers, employees, agents and affiliates are not liable for indirect, incidental, special, consequential or punitive loss arising from your use of the Products or the Site. Our total liability on any claim is capped at the amount you paid for the Product the claim concerns. Nothing here limits the money-back guarantee.
14. Indemnity
You agree to indemnify and hold harmless Ancho Solutions LLC against any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms or from Your Content infringing anyone else’s rights.
15. No other warranties
Apart from the commitments in these terms, the Products and the Site are supplied “as is” and “as available”, without other warranties, express or implied, so far as the law allows.
16. Your data
Our Privacy Notice applies to your use of the Site and the Products and forms part of these terms.
17. Text messages and emails
We use your email address and phone number to deliver your order and to contact you about it. We send marketing messages only if you opt in, for example with the optional box at checkout. Reply STOP to any text message, or use the unsubscribe link in any email, to stop them. We do not pass your details to anyone else for their own marketing.
18. Changes to these terms
We may revise these terms. A revision takes effect when it is published on the Site and never changes an order already placed.
19. If a clause fails
If a court holds any provision invalid or unenforceable, the rest stays in force, and the failed provision is read down only as far as needed to make it valid.
20. Governing law
These terms are governed by the law of the United States, without reference to conflict-of-law rules. Any dispute arising from them falls to the exclusive jurisdiction of the courts of the United States.
